Prior to Stott, the Court of Appeal had interpreted these sentences as being a new type of extended sentence where the court was required to determine the length of the sentence that was commensurate with the offence, and then add a year to the licence period (see for example R v Fruen [2016] EWCA Crim 561, [2016] All ER (D) 157 (May)).
